Andre Jacque and His Fight for Life

Last session with AB 305 (and the two sessions prior, though previous versions of the bill were not allowed to receive a public hearing) I proposed that no person may knowingly acquire, provide, receive, or use any body part from an aborted child (would not have applied to miscarried or stillborn children), regardless of whether the acquisition, provision, receipt, or use was for valuable consideration. Wisconsin’s pro-life groups (Wisconsin Right to Life, Pro Life Wisconsin, Wisconsin Family Action, Wisconsin Catholic Conference) all have agreed on this approach, particularly since the entities harvesting the organs from aborted children continue to use the unenforceable federal law to argue that they aren't "selling" the body parts to anyone, just being "reimbursed" for their costs in an essentially unregulated way (and middlemen at other institutions are used to sanitize the supply chain). There is and can be no legitimate justification for harvesting aborted children’s organs, and there are always ethical, equivalent or better alternatives for research (and there has been plenty of scientific expert testimony to that point).

The Darling/Duchow/Loudenbeck (LRB 1927) supposed prohibition on the sale of Baby Body Parts would have no real effect on the scandalous trafficking of freshly harvested aborted children’s organs into Wisconsin (which was the reason why I proposed AB 305 and its predecessors). I would see the enactment of LRB 1927 in its present form to be mere posing for political points and not actually accomplishing anything, while simultaneously putting a stamp of approval on the idea that human life is just another commodity whose dignity and worth can be devalued and rationalized away.

I am disappointed that the authors of LRB 1927 chose not to discuss the issue with me prior to circulating it, and that they are circulating it publicly for less than 24 hours (and starting after 5 pm at that) which is practically unheard of for a bill of this stature. Combined with today’s budget introduction, it would appear to be done in a rushed way to prevent a reasonable examination of its contents.

To my knowledge, LRB 1927 lacks the support of a single pro-life organization, nor was their input solicited. Why would that be the case if this is supposed to be solid pro-life legislation, and why would Republican legislative leadership seek to pass an abortionrelated bill that all pro-life groups refuse to stand behind? The Federal prohibition (originally written by a liberal Democrat Congressman) incorporated into LRB 1927 is completely toothless and has done nothing to stop abortion profiteers, as the undercover videos released last session have shown. There have been no prosecutions under the law, and the profits from the sale of aborted children’s organs is arrived at through a combination of essentially unregulated “fees” and “reimbursements”.

The authors’ co-sponsorship memo misleadingly states: “Many of you may have read the U.S. Senate Committee on the Judiciary’s report, ‘Human Fetal Tissue Research: Context and Controversy.’ This report states that the eminent failure with the current fetal tissue law is the lack of enforcement from the executive branch.”

What the co-sponsor memo does not mention is that the Senate report speculates that the federal law was not enforced because it is unenforceable!

“Accordingly, the Committee cannot assess whether the Justice Department prosecutors involved believed that the exemption to the ban on payments is too broad or vague to allow for enforcement…” (Page 2, bottom paragraph of the Senate report). The purported “conscience clause” contained in the bill would not even do anything to keep an employee objecting to participating in aborted children’s tissue research from being fired, but merely prevent them from being sued or criminally charged.

LRB 1927 does nothing to actually prevent or reduce demand for the body parts of aborted babies, nor the conduct of unnecessary experimentation on aborted children’s remains at the UW when ethically unproblematic, equivalent or better sources of tissue are already available. Neither the development of vaccines nor the production of vaccines themselves require fetal tissue (and none of the 75 vaccines available in the US are produced using fresh fetal tissue). Last session’s strong Baby Body Parts legislation would not have shut down any line of scientific inquiry, and a mere 0.2% of NIH funded grants from 2010-’14 utilize fetal tissue. The dependence of fetal tissue research on the abortion industry helps to legitimize abortion and to further embed it in our educational and medical institutions. Fetal tissue from abortions gives these institutions, like the UW, a vested interest in ensuring that abortions do not decline, let alone disappear. An aborted child did not consent to his or her destruction, yet LRB 1927 sanctions their dismemberment across state lines for the sake of “pushing the boundaries of science”.

Accordingly, I will stand in strong opposition to LRB 1927 in its present form.

PRO-LIFE ACTION LIST

1) Call Governor Scott Walker at (608) 266-1212 and demand he use his powerful budget pen to halt the Million$ going to Planned Parenthood and the Aborted Baby Body Parts industry.

2) Contact the Republican Party of Wisconsin at (608) 257-4765 and tell them to honor the GOP’s Party Platform to restore full legal protection to Wisconsin’s preborn children.

3) Contact your own Senator and Representative at the Legislative Hotline 1- 800-362-9472.

4) Boycott all fundraising appeals from the State Republican Party and individual GOP candidates until they honor the Party Platform with results.
